Booking & Payment
Session Fee
A non-refundable session fee of $200 is required to secure your booking. This session fee is non-refundable and may be transferable at the Photographer’s discretion.
Collection Selection
The Client will choose from one of three collections after viewing their online gallery.
Payment
Full payment for the selected collection and any additional products must be received before images are released or products are ordered.
Payments may be made via bank transfer or Stripe.
Cancellation & Rescheduling
Client Cancellation
If the Client cancels the session, the session fee is forfeited.
Rescheduling by the Client
Sessions may be rescheduled with a minimum of 48 hours’ notice, subject to availability.
Weather & Environmental Conditions
If a session is impacted by inclement weather or environmental conditions beyond the Photographer’s control, the session will be rescheduled at no additional cost, subject to availability.
Cooperation & Participation
Child Supervision
An adult must be present at all times to supervise children. The Photographer is not responsible for supervising children during the session.
Session Cooperation
The Client agrees to communicate respectfully and cooperate during the session.
The Photographer cannot guarantee specific images or poses and is not responsible if individuals fail to participate or cooperate.
Photography Restrictions
To ensure the Photographer can work without disruption, photography by family members or friends during the session is not permitted.
Health & Safety
The Photographer follows appropriate hygiene and safety practices.
The Client is responsible for informing the Photographer of any medical issues or illness prior to the session.
Timelines & Image Delivery
Gallery Delivery
The Client’s online gallery will be delivered within four weeks of the session date.
Gallery Availability & Selection Window
Online galleries remain active for 7 days from the date of delivery.
The Client must select their collection and finalise payment within this time.
Late Selection
If no selection or payment is received within 7 days, the gallery may be archived.
A gallery reactivation fee of $150 may apply to reopen an archived gallery.
Digital Delivery
Once payment is complete, digital images will be available for download via the online gallery. USBs or discs are not provided.
Extended Gallery Access – Full Gallery Collection
Clients who purchase the Full Gallery collection will receive extended online gallery access for 12 months from the date of gallery delivery.
After this period, galleries may be removed or archived without notice. Long-term online hosting is not guaranteed.
Clients are encouraged to download and back up their images promptly for safekeeping.
Image Specifications & File Management
Image Format
Images are supplied as high-resolution JPEG files at approximately 4500 pixels on the longest edge, suitable for printing up to 15 x 10 inches at 300ppi.
Image Management
The Client is responsible for downloading, storing, and backing up their images.
The Photographer is not responsible for user error or image loss after delivery.
File Retention
Digital files will be retained for three years. Long-term archiving beyond this period is not guaranteed.
Artistic Style & Image Selection
The Photographer’s work reflects her artistic style and professional judgement.
Culling Process
Images are carefully culled to remove duplicates, test shots, and unflattering expressions.
RAW Files
RAW files are not provided under any circumstances. Only final, edited images selected by the Photographer will be included in the gallery.
Copyright & Usage
Copyright
All images remain the copyright of the Photographer.
Usage Rights
Purchased images are for personal use only. Commercial use, resale, competitions, or publication without written permission is not permitted.
Editing & Alterations
Images must not be altered, filtered, or edited. Cropping for personal display is permitted.
Image Sharing & Children’s Privacy
Your child’s privacy is important to me. Images will only be used for portfolio, website, social media, or marketing purposes with written parent or guardian permission.
While parents provide legal consent, I also believe children deserve care and consideration around their digital footprint. For this reason, images are shared conservatively and never in a way that is overly personal, vulnerable, or identifying.
Clients may choose one of the following options at booking:
Permission for a small selection of images to be used for portfolio and marketing
Permission for non-identifiable images only
No permission for any images to be shared publicly
This selection will always be respected and may be updated in writing at any time.
Privacy Requests
If the Client wishes to keep images private, this must be requested in writing before or immediately after the session.
Print Quality & Products
The Photographer is not responsible for print quality, colour accuracy, or errors for products not ordered directly through her. For best results, prints larger than 10 x 15 inches should be ordered through the Photographer.
Liability
The Photographer takes reasonable care to create a safe and relaxed environment during sessions.
While every effort is made to ensure the safety of all participants, the Photographer cannot be held responsible for accidents, injury, loss, or damage that may occur during the session, except where required by law.
Clients are kindly asked to take care around the Photographer’s equipment and surroundings. Any damage caused to equipment or property as a result of negligence may be the responsibility of the Client.
Dispute Resolution
Any disputes will be handled in good faith.
If a resolution cannot be reached, disputes will be referred to mediation before legal action is pursued.
Australian Consumer Law
Nothing in these terms excludes or limits your rights under the Australian Consumer Law.
In the event of a major failure, the Client is entitled to remedies as required by law.
By booking with Gemma MacLennan Photography, you acknowledge that you have read, understood, and agree to these terms and conditions.
